Privacy

In short

We collect only what you or your business send us, or what is publicly listed for business contact. We use it to answer you, do the work and reach out to brands. We do not sell it, and this site sets no cookies and runs no trackers.

Who we are

This site is run by Hauserman Listing Guard, based in Boynton Beach, Florida, USA. We decide how the information described here is used. You can reach us at joshua@hlgflorida.com.

What we collect

  • What you send us. The details you put in an email or in the Dupe Audit form: your name, email address, brand, the countries you sell in, marketplace links, and anything else you choose to tell us. The form opens your own email app, so the message travels by email and is not stored by a form service on this site.
  • Business contact details of prospects. For brands we think we can help, we keep a business name, a business contact name and role, and a business email address or professional profile, taken from sources such as company websites and professional networks.
  • Client records. If you hire us, the contract, the rights information you give us, evidence we gather, and our messages with you.
  • Technical data. Like most web servers, ours may log standard technical details of each visit, such as your IP address, the page requested and the time. We do not use this to profile you.

Why we use it, and our legal basis

We use your information to respond to enquiries, to provide brand protection services, to run our business and to contact brands that may benefit from our service (business-to-business outreach).

For people in the UK and the EU, the basis under the UK GDPR and the EU GDPR is:

  • Legitimate interests for answering enquiries, business-to-business outreach and running a secure site. We think a business contact hearing about a service relevant to their brand is a reasonable expectation, and you can object at any time.
  • Contract for clients, so that we can deliver the services you hired us for.

Who sees it

We do not sell personal data. We share it only as needed to do the work: with the marketplace when we file a notice on your behalf, which includes the brand owner's name and contact details; with our partner fractional IP attorney or qualified local counsel if you ask for legal work; and where the law requires it.

How long we keep it

We keep information only as long as we need it for the purpose it was collected. Enquiries we do not follow up are deleted. Prospect contact details are kept until you ask us to stop or we no longer need them. Client records are kept for the length of the engagement and afterward only as long as legal, tax and accounting rules require. If you ask us to delete something, we will, unless the law requires us to keep it.

Your rights

You can ask us to:

  • tell you what we hold about you and give you a copy (access);
  • correct anything that is wrong;
  • delete your information (erasure);
  • stop using your information for outreach or other uses based on legitimate interests (objection);
  • restrict how we use it, or give it to you in a portable format, where those rights apply.

To use any of these, email joshua@hlgflorida.com. To stop outreach, reply to any message with the word "unsubscribe" or email us, and we will add you to a do-not-contact list and not message you again. We keep only your email address on that list so that we can honor your request. If you are in the UK or EU, you may also complain to the UK Information Commissioner's Office or to your local data protection authority.

People in Canada

Canada's federal privacy law, PIPEDA, covers private-sector organizations that collect, use or disclose personal information in the course of commercial activities. Quebec, Alberta and British Columbia have their own private-sector laws. In Quebec, the Act respecting the protection of personal information in the private sector, overseen by the Commission d'accès à l'information, covers an organization located outside Quebec that handles personal information in the course of its business activities in Quebec.

Withdrawing consent. If you are in Canada, you can withdraw consent to our use of your information at any time, subject to legal or contractual restrictions and reasonable notice, as the Office of the Privacy Commissioner of Canada explains. Email joshua@hlgflorida.com and we will tell you what withdrawing means for the service you have asked for.

Unsubscribing from outreach. To stop business outreach, reply with the word "unsubscribe" or email us, and we will stop messaging you without delay and in any case within 10 business days, at no cost to you. You can ask us for access to, correction of or deletion of your information in the same way. If you are in Canada and have a complaint, you can contact the Office of the Privacy Commissioner of Canada or, in Quebec, the Commission d'accès à l'information.

International transfers to the US

We are in the United States, so information you send us from the UK, the EU or Canada is sent to and processed in the US, where data protection rules differ from those in your country. If you do not want that, do not send us personal data, and contact us if you have questions or want to exercise your rights.

Cookies and trackers

This site sets no cookies and runs no analytics, advertising or tracking scripts. One third party is involved in loading pages: the Inter typeface is delivered by Google Fonts, so your browser requests it from Google's servers, which receive your IP address as part of that request. We do not control that data.
