Can I enroll in Amazon Brand Registry for amazon.ca with a US trademark?
Short answer
Maybe, but Amazon's public pages do not promise it. Amazon says the mark must come from the trademark office of a country with a corresponding Amazon store, and it recommends a mark for each store you sell in. It does not publicly say a US-only mark enrolls you on amazon.ca, so confirm before you plan around it.
What does Amazon say about Brand Registry eligibility?
Amazon's Brand Registry page for Canada sets out a short list. You need a logo with your brand name permanently affixed to your products or packaging. You need a pending or registered trademark for your brand name or logo. And only the brand owner can enroll. An authorized agent should have the owner enroll the brand and then be added as a user.
The mark can be a word mark, or a design mark that contains words, letters or numbers, and the trademark text must match the brand name on your application. That detail trips up more brands than the office question does, so check your own registration against it.
Does a US trademark work for amazon.ca?
This is the open question, and we would rather say so than guess. Amazon says the trademark must be issued by "the designated government trademark office of a country with a corresponding Amazon store." Canada has an Amazon store. The United States has one too.
What Amazon's public page does not do is name the USPTO or the Canadian Intellectual Property Office (CIPO), or say which offices are accepted for which store. The country-specific requirements are behind a login. So a statement like "your US registration enrolls you on amazon.ca" is not something we can source, and you should be wary of anyone who states it as settled fact.
Two further facts from the same page matter. If you want protection in several countries, you pick one office at enrollment and can add others after approval. And Amazon recommends submitting a trademark for each country-based store you want to sell in. Read together, that points toward holding a Canadian mark if amazon.ca matters to your business. It is a reading of Amazon's wording, not a rule Amazon has stated.
Why does it matter that a US mark is not a Canadian right?
Separately from Amazon, trademark rights are territorial. The USPTO's overseas IP toolkit says a US trademark does not afford protection in another country. We walk through the Canadian side in our post on whether a US trademark protects you in Canada. Even if a platform accepts your US mark for enrollment, that does not create Canadian trademark rights.
Can I enroll with a pending application?
Amazon's page says you may need a pending or registered trademark, and its FAQ says that in some cases you may enroll with a pending trademark registration. "In some cases" is the operative phrase. Amazon does not publicly list which offices or situations qualify, so the only reliable answer is what the enrollment flow shows for your brand.
Do not assume a pending Canadian filing gets you in. Check inside Brand Registry, or ask an Amazon-vetted provider, before you build a launch plan on it.
What is IP Accelerator, and is it relevant in Canada?
Amazon says its IP Accelerator program can connect you with Amazon-vetted legal service providers, and that it is meant for brands without a trademark, to help them trademark the name or logo and enroll faster.
For Canada, Amazon's April 26, 2021 announcement said the program connects Canadian small and medium-sized businesses with a curated network of local law firms at reduced, pre-negotiated rates. Amazon said sellers do not pay Amazon to use it and instead pay their law firm directly. It also said participating businesses can access Amazon's brand protection tools months before their trademark registration is issued, and that individual CIPO applications can take up to 28 months.
That announcement is more than five years old, so treat the details as background and confirm current terms on Amazon's program page. We do not quote fees or timelines.
What can I do about copycats while I sort out enrollment?
Do not wait. Amazon publishes a public infringement reporting form for amazon.ca, so you can report a listing without Brand Registry. Brand Registry adds tools: Report a Violation, Transparency, which uses unique serial codes against counterfeits, and Project Zero, which lets brands block and remove listings immediately. Amazon says each report "helps strengthen our automated protections." None of that is a promise of removal in every case.
Evidence still decides outcomes. A clear side-by-side of your product and the copy, your mark or your photos, and the right claim type give a reviewer something to act on. Our posts on why Amazon rejects infringement reports and trademark versus copyright complaints cover the common mistakes. Copyright in your own product photos exists without a Canadian filing, which is often the fastest claim for stolen images.
This is general information, not legal advice. Questions about which Canadian filing fits your brand belong with a qualified Canadian trademark agent or independent licensed IP counsel.
